Terms of Service

1. Agreement to Terms

By accessing or using the CandiScan platform ("Service"), operated by CandiScan LLC ("CandiScan", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all users of the Service, including recruiters, employers, team members, and any person who interacts with the platform.

2. Description of Service

CandiScan is a candidate screening platform that helps recruiters verify candidate authenticity. The Service includes:

  • CV/resume parsing and verifiable claim extraction
  • Generation of candidate-specific interview questions based on CV content
  • AI-powered or human-conducted pre-interviews
  • Evidence-based verification flags with full reasoning
  • Candidate management and reporting dashboard

The Service is a screening assistance tool. It does not make hiring decisions. All flags and assessments are advisory and subject to human review and override.

3. User Accounts

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Each account is associated with a team (your organization). Team owners may invite additional team members and assign roles. You are responsible for ensuring that all users within your team comply with these Terms.

You must notify us immediately at hello@candiscan.com if you become aware of any unauthorized use of your account.

4. Your Responsibilities

As a user of the Service, you agree to:

  • Use the Service only for lawful recruitment and candidate screening purposes
  • Ensure you have a lawful basis to process candidate personal data through the platform, including informing candidates about the screening process
  • Not use screening results as the sole basis for hiring or rejection decisions
  • Review all flags and evidence presented by the platform before making decisions
  • Not use the Service to discriminate against candidates on the basis of race, ethnicity, gender, age, disability, religion, sexual orientation, or any other protected characteristic
  • Not submit false, fabricated, or misleading data to the platform
  • Not attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Not share account credentials or allow unauthorized access to the platform

5. Candidate Data Processing

When you upload candidate data to the Service, you act as the data controller and CandiScan acts as a data processor on your behalf. You are responsible for:

  • Having a lawful basis to process candidate data (such as legitimate interest in verifying candidate claims for a role they applied to)
  • Informing candidates that their CV will be analyzed and that they may be invited to a pre-interview
  • Responding to candidate data access, correction, or deletion requests that relate to your use of the platform

CandiScan informs candidates about the screening process before the pre-interview begins and provides candidates with a direct channel to request data deletion.

6. Intellectual Property

The Service — including its software, design, algorithms, documentation, and branding — is the exclusive property of CandiScan LLC and is protected by copyright and other intellectual property laws.

You retain ownership of all data you submit to the Service, including candidate CVs, company information, and any notes or overrides you add. By using the Service, you grant CandiScan a limited license to process this data solely for the purpose of delivering the Service.

Screening reports and evidence flags generated by the Service are licensed to you for use in your internal recruitment processes. You may share reports with colleagues involved in the hiring decision. You may not resell, sublicense, or publicly distribute generated reports.

7. Service Availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to notify users in advance of planned maintenance that may affect availability.

8. Disclaimer

The Service is provided "as is" and "as available." CandiScan does not warrant that:

  • Screening results are 100% accurate — the Service identifies potential concerns based on available evidence, but false positives and false negatives may occur
  • The Service will detect all instances of candidate fraud or misrepresentation
  • The Service meets the specific requirements of your jurisdiction's employment laws beyond what is stated in our compliance documentation

The Service is designed to assist human decision-makers, not replace them. You are responsible for exercising your own judgment when interpreting screening results.

9. Limitation of Liability

To the maximum extent permitted by law, CandiScan LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Hiring decisions made based on screening results
  • Loss of profits, revenue, or business opportunities
  • Loss of data or unauthorized access to your account
  • Service interruptions or unavailability

Our total liability for any claims arising from or related to the Service shall not exceed the total fees you have paid to CandiScan in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless CandiScan LLC from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of applicable data protection or employment laws.

11. Termination

You may close your account at any time by contacting hello@candiscan.com. Upon account closure, we will delete your data in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm other users or the platform. We will provide notice before termination where reasonably possible.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising from these Terms or the Service shall be resolved in the courts of Tallinn, Estonia.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
